Council agrees a position on the EU Inc. company framework

Hungarian startups also have a stake in the eventual terms of a framework usable across borders.

On 23 October, the Council of the EU adopted its negotiating position on the EU Inc. framework. The proposed optional system would allow online company formation within two days for no more than EUR 100. For a Hungarian technology business, the administration of expansion abroad is the most immediate point of relevance.

The institutional release says that the European Parliament's position is still needed for negotiations. This step therefore establishes a negotiating basis: founders cannot currently order the described procedure merely by invoking this decision.

The fee ceiling and processing period concern the cost of entry. A business's full operating budget may also include accounting, advice, employment and financing. Assessing the future framework requires separate quotations and applicable rules for those items; the proposed incorporation fee is not an estimate of total business costs.

The next substantive developments will be Parliament's position and interinstitutional negotiations. It will be useful to compare how much of the promised speed and cost reduction survives in the final text. Our earlier report on startup hubs covers the business-development environment, while our digital rulebook report explains the regulatory background. These are distinct initiatives; support under one does not confer automatic eligibility for benefits under another.

Choosing where to incorporate also involves ownership rights, enforceability of contracts and local administration. Those can be compared once the final rules are known; until then, the announcement serves as planning information.
