The Council of the European Union and the European Parliament reached a provisional political agreement on 21 October to amend securitisation rules. The package would apply more risk-sensitive and lower bank capital requirements to transactions deemed safe and create a new “resilient” category. For Hungarian banks and corporate borrowers, the practical question is how the final rules may alter the funding and transfer of loans.
Securitisation pools corporate, mortgage or consumer loans into tradable instruments. According to the Council release, third-party entities checking STS compliance would come under EU-level supervision, while certain investment limits for UCITS funds would rise. Higher requirements would remain for riskier positions.
The agreement is not yet applicable law. The legal texts must be finalised and then formally endorsed by both the Council and Parliament. The next point to watch is therefore the final wording and the date on which banks must apply it. Read our related coverage of the ECB financing message and the latest MNB rate decision.
